Definitions

  1. Approved Expenses
    Approved Expenses are expenses deducted from the total money paid by Competitors as Bets in a Dietbet. Compensation for Referees is an example of  an Approved Expense. If the Organizer uses DietBet to collect bets, manage the Prize Pot, and disburse winnings, the fees associated with this service are also Approved Expenses.
  2. Bet
    A Bet is money paid by a Competitor in a Dietbet at the beginning of a Dietbet. The Bet is added to the Prize Pot, which will be distributed to the winners of the Dietbet after the final Weigh-In.
  3. Competitor
    Competitors are the participants in a Dietbet.  They are eligible to split the Prize Pot (if any) in the event that they meet their weight-loss goals.  A competitor may also be an Organizer.
  4. Dietbet
    A Dietbet is a 28-day contest to lose weight.  Dietbets must have at least two players but there is no upper limit.  Most Dietbets involve betting into a Prize Pot. Other Dietbets are strictly for non-monetary stakes, or Bonus Stakes.
  5. Organizer
    The Organizer initiates the contest, invites competitors to play, names the Dietbet, sets parameters (including the total weight or percentage of weight to lose and the size of the Bet, including any Bonus Stakes), and may appoint a Referee. The Organizer may be a Competitor. Unless a Referee has been engaged, the Organizer shall be responsible for all Referee duties.
  6. Prize Pot
    The Prize Pot is the amount of money, if any, that will be split among the Competitors of a Dietbet who meet their Target Weights as of Day 28 of a Dietbet.  The Prize Pot can be zero if the Dietbet is being played strictly for non-monetary stakes.  If Competitors have bet into the Prize Pot, the Prize Pot is the sum of the Bets minus any Approved Expenses.
  7. Referee
    Referees may be appointed solely by the Dietbet's Organizer to officiate at Weigh-Ins, record weights, collect Bets in the beginning and disburse the Prize Pot at the end, arbitrate disputes, and manage logistics such as the time and location of Weigh-Ins.  The Organizer may choose to perform these duties directly, without an outside Referee. The Referee may not be a competitor.

Rules

  1. Weigh-Ins
    1. Weigh-Ins shall be officiated by the Referee and shall take place once per week at a set time and place. The first and last Weigh-Ins (on Day 1 and Day 28) are mandatory; others are optional.
    2. Dress Code.
      1. Weigh-in dress code is “Airport Security Attire” (No shoes, no belt, no watch, empty all pockets, no outerwear, no pocketbook or other accessories, etc).
      2.  At the first Weigh-In, the Referee or Organizer will record what each competitor wears to ensure that competitors wear substantially the same clothing at subsequent Weigh-Ins.
      3. Organizers may, at their discretion, require that Competitors be photographed while they are being weighed.  These pictures (or videos) shall are be used to ensure compliance with the Dress Code.
    3. Mandatory Attendance. The first and last Weigh-Ins are mandatory; missing either shall result in disqualification (with no refund of Bet or fees).  Arriving more than 30 minutes late to a mandatory Weigh-In may result in ejection from the game, at the discretion of the Organizer, with no refunds.
    4. Times and locations of Weigh-Ins shall be communicated on the DietBet website by the Organizer. The Organizer has the right to move or reschedule Weigh-Ins for any reason.
    5. Officiating at Weigh-Ins. The Organizer or Referee shall be responsible for weighing all competitors, recording weights, and entering weight data into the DietBet database.
    6. Rounding. Weights shall be rounded to the nearest pound using the half-up rounding method. If the game is using kilograms, weights shall be rounded to the nearest tenth of a kilogram (e.g., 74.6 kgs).
    7. Posting Weights. The Referee or Organizer shall be responsible for posting official weights on the DietBet website, or via a mobile app, after each Weigh-In.
    8. Competitors may post their own unofficial weights as frequently as they wish.
      1. Scales.
        1. The same scale should be used throughout the Dietbet whenever possible.
        2. Scales should be the highest-quality obtainable.
        3. The Organizer or Referee shall calibrate (“zero” or “tare”) the scale before each competitor is weighed.
        4. In cases where a scale does not reliably generate the same results repeatedly (as with some scales, particularly digital scales), competitors shall be weighed three times in a row and the results averaged.
      2. First Weigh-Ins and Target Weights.
        1. At the first Weigh-In, competitors’ Starting Weights shall be recorded by the Organizer or Referee and posted to the DietBet website or mobile app. Actual weights may be hidden if the Competitor prefers to keep this private; only relative weights need to be shown on the DietBet page.
      3. Target Weights shall be calculated by taking the Starting Weight and subtracting the amount to lose. In some cases, the amount to lose is a fixed number (e.g., 8 lbs); in other cases, it is calculated on a Competitor-by-Competitor basis as a percentage of that Competitor's Starting Weight.
      4. Final Weigh-Ins. After the final Weigh-In data has been recorded, the winners are declared. Results must be ratified by the Organizer.
      5. Winning and Ties.
        1. Any Competitor who weighs in at or below his or her Target Weight at the final Weigh-In shall be deemed a winner unless any of the following conditions are true:
          1. Their total weight loss is more than twice the difference between their starting weight and their target weight and is also greater than six pounds.
          2. They have been ejected by the Referee or Organizer.
        2. If no competitors have reached their Target Weight by the final Weigh-In, the competitor who has come the closest to his or her Target Weight, percentage-wise, shall be deemed the winner. "Percentage-wise" is calculated by dividing the number of pounds lost during the contest by the difference between the Starting Weight and the Target Weight.
        3. Competitors do not gain any special prizes or bonuses for reaching their Target Weight first or for exceeding their Target Weight.
        4. If no competitor has lost any weight, a No-Lose scenario is declared as described in Section 2.5.
  2. Betting
    1. Mechanism of Betting. Each Competitor’s Bet must be placed before the first Weigh-In. The Referee/Organizer has the right to eject any Competitor who has not made their Bet before the first Weigh-In.
    2. Pot. Bets shall be entrusted to a unanimously agreed upon agent, such as the Referee or Organizer. DietBet can also manage the collection and disbursement of money in the Prize Pot for a fee.
    3. Payments. If there is just one winner after the conclusion of the Dietbet, that person wins the Prize Pot. If there is a tie, the Prize Pot, less Approved Expenses, is divided equally among the winners. If there are no winners, a No-Lose Scenario is declared, as defined in Section 2.5.
    4. Approved Expenses. The Prize Pot is the sum of the Bets paid by Competitors in a Dietbet minus Approved Expenses, which shall be deducted prior to making any payments (including payments in a No-Lose Scenario). Approved Expenses may include paying the Referee, paying for pot-management services, and paying for general overhead expenses, such as the purchase of a scale. The Organizer shall have sole authority to approve expenses.
    5. No-Lose Scenario. In the event that there are no winners at the end of the contest, the Prize Pot shall be donated to a charity chosen by the Organizer at the outset of the contest.  Individual Competitors may choose to receive a refund instead of donating their Bet to charity.  The refund will be equal to the Prize Pot divided by the number of Competitors in the Dietbet.  This may be less than the original Bet due to the subtraction of Approved Expenses.
    6. No Extra Credit. In a tie, the Prize Pot is split equally among the Winners, regardless of how many pounds each Winner has lost during the Dietbet, or how quickly.
    7. No Simultaneous Play. A Competitor may not participate in more than one Dietbet at the same time.
  3. The Organizer
    1. Disputes. The Organizer shall have the authority to resolve disputes that may arise from time to time. The Organizer’s ruling in all such matters shall be final. The Organizer may irrevocably transfer these duties to a third-party Referee.
    2. Compensation. The Organizer shall not be compensated for his or her services. However, a third-party Referee may be compensated, with the amount negotiated by the Organizer.  Such compensation, if any, shall be considered Approved Expenses and deducted from the Prize Pot prior to payment.  The compensation must be set before the Dietbet begins and cannot be changed after the first Weigh-In.
  4. Unsafe and Unsportsmanlike Behavior
    1. Any competitors caught engaging in prohibited practices may be ejected at the sole discretion of the Organizer/Referee.  Ejected players shall not be entitled to a refund of fees or bets.  The following practices are prohibited:
      1. Binging or hydration.
      2. Purging (self-induced vomiting).
      3. Excessive dehydration.
      4. Engaging in weight-loss medical procedures during the course of the Dietbet.
      5. Any unsportsmanlike behavior, as deemed by the Organizer/Referee.
      6. Some medications or substances have primary effects or side effects that cause weight-gain or weight-loss. Competitors who use such medications or substances may be disqualified in the following cases:
        1. The medication or substance can cause weight-loss and was used by the Competitor while, or up to three months prior to, participating in a Dietbet.
        2. The medication or substance can cause weight-gain and was used by the Competitor up to one year prior to participating in a Dietbet.
      7. Other attempts at tampering with or “fooling” the measurement reported by the scale.
    2. Unsafe Weight Loss.  A Competitor who loses more than twice their target amount during a Dietbet shall be disqualified unless the total weight lost is less than or equal to six pounds.
    3. Players must adhere to commonly accepted guidelines of good sportsmanship and polite decorum. Players agree not to engage in the following acts and will be warned or expelled at the sole discretion of the Referee:
      1. Intentionally misrepresenting one's weight.
      2. Playing repeatedly as a professional ("hustling").  After a Competitor finishes a Dietbet that Competitor cannot enter another Dietbet unless at least one of the following conditions  is true:
        1. More than sixty days have elapsed between the end date of the first Dietbet and the start date of the second Dietbet.
        2. The Competitor's starting weight at the second Dietbet is less than or equal to the average of their Starting Weight and Ending Weight from the first Dietbet.
      3. Manipulating the Dietbet, including colluding, betting on a Dietbet you are not competing in, betting on someone other than yourself, betting on someone to lose, or otherwise interfering with the fair and natural course of the Dietbet.
      4. Harassment of players.
      5. Embarrassing other players.
      6. Disclosing confidential information such as the weight of a Competitor without their permission to do so.
      7. Posting photos of others without their permission.
      8. Using the program to offer rewards for actions over which they have no control or influence.
      9. Age. You must be at least 13 years old to participate in a Dietbet. If you are under 18 you must have permission from a parent or guardian to play.
  5. Disclaimer and Indemnification
    1. Consult with your doctor or qualified nutritionist before engaging in a Dietbet. Dietbets are intended to provide fun, enhanced motivation for people to engage in safe, healthy lifestyle changes. There are risks to playing which the Competitor bears.
    2. Do not engage in a Dietbet where you cannot safely lose the required weight in the required time, or when you cannot afford to lose the money that you Bet.
    3. DietBet, Inc. does not permit use of its services for dietbetting in jurisdictions where such contests are illegal.
